  • your name, contact details, date of birth and emergency contact details;

  • membership, booking, attendance, payment and transaction information;

  • information you provide when communicating with us or making an enquiry or complaint;

  • health and safety information relevant to our services, as described below;

  • photographs or recordings taken for purposes such as promoting Life Energy Fitness;

  • images and footage captured by CCTV; and

  • information relevant to an application to work with us or to a role at Life Energy Fitness.

Health and Other Sensitive Information

The health and other sensitive information we collect where relevant to our services may include, but is not limited to, pre-exercise screening answers, medical conditions, injuries, medications, allergies, management plans and medical clearances. We collect sensitive information with your consent unless the law otherwise permits or requires collection. We limit its use and disclosure to appropriate purposes, including exercise guidance, safety, emergency response and our legal obligations.

How We Collect Information

We usually collect information directly from you when you contact us, complete a form, join, make a booking, attend, make a payment or use our website or online services. Where appropriate, we may collect information from a parent or guardian, an authorised representative, a school, a health professional or another person involved in providing our services. We may also collect information through our membership and booking systems, website and social media interactions.

We use CCTV in appropriate areas of our premises and surrounds to support the safety of members, visitors and staff, and to help prevent and investigate incidents, crime and misconduct. We handle CCTV footage in accordance with this Privacy Policy.

You can make a general enquiry without identifying yourself where practicable. If you choose not to provide information we reasonably need, we may be unable to provide a particular service or support safe participation.

How We Use Information

We use personal information to respond to enquiries; provide and manage our services; administer memberships, bookings and payments; support safe participation; communicate with you; respond to incidents and emergencies; protect people and property; meet legal and recordkeeping obligations; and improve our operations.

We may take and use photographs or recordings from our classes, programs and events to promote Life Energy Fitness, including on our website and social media. Where reasonably practicable, we will let people know when promotional photography or filming is taking place. You can ask us not to photograph or record you, or not to use an identifiable image of you for promotional purposes. We will seek parent or guardian permission before using identifiable images of children for promotion. Requests concerning promotional images are explained below.

We may contact you about our programs, services or offers where permitted by law. You may opt out of marketing communications at any time using an unsubscribe option or by contacting us. We may still send necessary account, booking, safety and service messages.

When We Share Information

We may share information with staff and other people authorised to assist with our operations; service providers that support our membership system, bookings, payments, website, communications, security and recordkeeping; and professional advisers, insurers, health professionals, emergency services or authorities where appropriate and lawful. We share only what is reasonably needed for the relevant purpose. We do not sell personal information.

CCTV footage may be used for management, safety and security, and may be provided to law enforcement or government bodies where permitted or required by law.

GymMaster supports our membership and booking services. Square processes card payments; full card details are generally handled by the payment provider, while we receive information needed to manage transactions and accounts.

Website and Online Services

Our website is hosted by Squarespace. When you use our website and online services, we may automatically collect information about your interaction with them. This may include your IP address, device and browser details, pages viewed and how you use the site. We may collect this information through cookies and similar technologies to operate the website, understand site activity and improve our online services. You can manage cookies through your browser settings and any choices offered on our website. Services linked from or added to the website may have their own privacy policies.

Overseas Handling

We use systems and third-party service providers, including cloud-based services, that may store, access or process personal information outside Australia. These include GymMaster for membership and bookings, Square for payments and Squarespace for our website.

Based on information published by these providers, personal information may be handled in the United States, Japan, Germany, Singapore, New Zealand, Canada, Ireland, France, Spain and the United Kingdom. The countries relevant to particular information depend on the services and account arrangements in use and may change over time.

Storage and Security

We take reasonable steps to protect personal information from misuse, loss and unauthorised access, modification or disclosure. Access is limited to people who need the information for their work. We retain information for as long as reasonably needed for our services and legal obligations, then take reasonable steps to securely destroy or de-identify it when it is no longer required.

Access and Correction

You may ask to access the personal information we hold about you or request a correction if it is inaccurate or out of date. Contact us using the details below. We may ask you to verify your identity and will respond within a reasonable time. If we cannot provide access or make a requested correction, we will explain why where required by law.

Deletion Requests and Promotional Images

You may ask us to delete personal or sensitive information we hold about you. We will consider your request and take reasonable steps to delete or de-identify information that is no longer needed, unless we need to keep it for a lawful purpose, such as a legal, safety, accounting or recordkeeping obligation. Deleting certain information may affect our ability to provide services to you.

You may tell staff or contact us if you do not wish to appear in promotional photographs or recordings. You may also withdraw permission for their future promotional use. We will respect that choice for future use. If you ask us to remove an image we have already published, we will review what we can reasonably remove from channels we control. We may not be able to remove copies that others have already shared or material already distributed.
